WOMBAT WASH — SERVICE TERMS AND CONDITIONS

These terms apply to all services provided by Wombat Wash. For one-off services, engaging our service constitutes acceptance. For subscription services, acceptance is confirmed by ticking the agreement box at signup.

1. INTRODUCTION

These terms and conditions govern all services provided by Wombat Wash to domestic and commercial clients, including, but not limited to, high-pressure cleaning, soft washing, surface treatment, fleet care, and bin cleaning. By engaging Wombat Wash, you agree to be bound by these terms.

2. SCOPE OF SERVICES

Wombat Wash provides professional cleaning services across a range of disciplines. While we bring significant experience and appropriate equipment to every job, not all marks, stains, contaminants or materials can be fully removed. Customers acknowledge the inherent limitations of cleaning services and accept that complete removal of all soiling is not always achievable. High-pressure cleaning, soft washing, chemical application, and related methods carry inherent risks, including overspray, surface contact, and water runoff. Incidental cleaning or contact with adjacent surfaces resulting from normal operations does not obligate Wombat Wash to clean those areas fully or to any specific standard. Specific limitations applicable to bin cleaning services are set out in Section 7.

3. PRICING AND PAYMENT

One-off and quoted services: Pricing is provided per job by quote. Payment is due upon completion of works via cash, EFTPOS (merchant fees may apply) or bank transfer. A 10% non-refundable deposit is required on all quoted services to secure the booking. Subscription services (bin cleaning): Fees are charged monthly in advance via the payment method provided at signup. Payment reserves your place on the scheduled route for that month. All subscription fees are non-refundable once a service period has commenced. Unpaid invoices will receive a payment reminder before being referred to debt collection. The customer is responsible for any additional fees and charges arising from debt recovery.

4. CANCELLATION AND RESCHEDULING

One-off and quoted services: Cancellations or rescheduling requests received with less than 24 hours’ notice may incur a rebooking fee. The 10% deposit is non-refundable in all circumstances. Subscription services (bin cleaning): You may cancel at any time by managing your subscription through your Square payment account. To take effect at the end of your current billing period, cancellation must be submitted no less than 72 hours before your next scheduled payment date. Cancellations submitted within 72 hours of the next payment date will take effect at the end of the following billing period, and one additional payment will apply. No refund is issued for any unused portion of a paid period. Wombat Wash may cancel a subscription agreement at any time by written notice. If we cancel without cause, a pro-rata refund for the unused portion of the current period will be issued.

5. CUSTOMER RESPONSIBILITIES

All services: Customers are responsible for ensuring safe and reasonable access to the work area. Any known hazards, sensitivities or conditions relevant to the service should be disclosed before commencement. Failure to disclose relevant information may affect the outcome of the service and does not give rise to any claim against Wombat Wash. Bin cleaning subscriptions: You agree to present all registered bins kerbside on every council collection day, regardless of whether you expect that bin to be cleaned on that visit. Our scheduling system determines which bins are cleaned on which visit — if a bin is not present when we attend, that visit is considered fulfilled for that bin, and no credit, makeup, or refund applies. You agree to maintain unobstructed kerbside access on your collection day. Removal or defacement of Wombat Wash identification labels may result in that bin being excluded from scheduled cleans without credit or refund.

6. LIABILITY AND WARRANTIES

Customers acknowledge and accept the risks inherent in professional cleaning services, including the use of water, high-pressure equipment, chemicals and related methods. To the extent permitted by law, Wombat Wash disclaims liability for damage to persons or property arising from normal cleaning operations, pre-existing conditions, undisclosed hazards or circumstances beyond our reasonable control. For subscription bin cleaning services, our liability for any single claim is limited to completing a makeup clean at the next scheduled visit. We are not liable for indirect, consequential or economic loss of any kind under any service type. Nothing in these terms excludes any consumer guarantee or right that cannot be excluded under the Australian Consumer Law.

7. BIN CLEANING — SPECIFIC TERMS

Service delivery: We attend twice per month and clean your registered bins according to your chosen plan. We determine the specific bins cleaned on each visit based on your plan, the council collection week type and our route schedule. Each registered bin is fitted with a Wombat Wash identification label for service identification purposes only. Service limitations: Our standard service removes typical organic waste, odour and residue using high-pressure water and approved sanitiser. Staining, discolouration or contamination from paint, dye, oil, chemicals or similar substances is outside the scope of standard cleaning. If a bin cannot be restored to a reasonable standard through normal cleaning methods, we will advise you, but no additional attempts, credits or refunds apply. Hazardous bins: We reserve the right to skip any bin containing sharps, needles, chemical waste, biological hazards, or any substance we reasonably consider unsafe. Skipped bins in these circumstances are considered fulfilled for that visit, and no credit or refund applies. Wastewater: Bin cleaning produces greywater containing cleaning agents and organic residues. This wastewater will be directed to lawns, garden beds or other locations on or near your property in accordance with WA environmental guidelines. We take reasonable care in managing runoff, but cannot guarantee placement to any specific location. We may access a suitable water source on or near your property where required for service delivery. By engaging our bin cleaning service,e you acknowledge and accept these conditions. Missed cleans: If we miss a clean due to our error, we will complete a makeup clean at the next available visit. No cash refund or credit applies. We are not liable for missed services due to extreme weather, road closures, equipment failure or other circumstances beyond our reasonable control. One-off bin cleans: One-off cleans are subject to availability and must align with our scheduled collection run for your address. Payment is required in full at booking and is non-refundable. If a bin is not presented on the agreed day, the service is considered fulfilled, and no refund or rescheduling applies. Failed payments: Failed payments will result in immediate service suspension. If payment is not resolved within 7 days, your account may be cancelled. Pricing may change with no less than 30 days’ written notice to active customers.

8. INSURANCE

Wombat Wash carries public liability insurance appropriate to the services provided. Proof of currency is available on request.

9. PRIVACY AND DATA PROTECTION

Wombat Wash adheres to the Australian Privacy Principles as outlined in the Privacy Act 1988 (Cth). Further information is available at https://www.oaic.gov.au. We collect personal information, including name, address, phone and email, solely for the purpose of delivering and administering our services. This information is not sold or disclosed to third parties except as required to process payments or meet legal obligations. Payment processing for subscription services is handled by Square — we do not store card or financial account details.

10. DISPUTE RESOLUTION

We are committed to resolving any concerns directly and promptly. In the first instance, please get in touch with us at info@wombatwash.com.au. If a dispute cannot be resolved through direct communication, it will be referred to arbitration. Arbitration costs are the responsibility of the party initiating the process. Customers are encouraged to provide honest feedback. We ask that any concerns be raised directly with Wombat Wash before publishing reviews or other public commentary, giving us a reasonable opportunity to respond and resolve the matter.

11. GENERAL

These terms are governed by the laws of Western Australia. If any provision is found to be unlawful, void or unenforceable, it will not affect the validity of the remaining provisions. We may update these terms from time to time. For one-off service,s the current terms at the time of engagement apply. For subscription customers, we will provide no less than 14 days’ notice of material changes — continued use of the service after that date constitutes acceptance.
